The Biggest Reason For Lifting The Curfew In Kashmir

The Government Of India did what it did on Article 370, but the people of Kashmir have a right to challenge that decision and take it all the way to the Supreme Court. Maybe the Supreme Court will side with the Government of India, maybe it will not. We can not know beforehand. But there is no avoiding that route. You can not wish the Supreme Court away. You can not wish the judicial process away.

The curfew should be lifted. And the people of Kashmir should be told loud and clear, if they disagree with the decision, their best option is to take the issue to the Supreme Court of India, and to that end, they should organize peaceful gatherings in indoor locations and marshall their arguments after deliberations and discussions. That peaceful political process has to be encouraged to the hilt.

The curfew is inhumane. It is not the democratic way. And it needs to be lifted immediately. It has been two months already. That is two months too long.

Of course, all politicians, all intellectuals in Kashmir who have been put under house arrests if not outright taken to jail should be release immediately. Maybe they would like to give the Delhi government a wait and watch mode. Or maybe they disagree and they would like to go to the Supreme Court. That judicial process should be encouraged to the hilt. That might not be enough. But that might be one way to make the situation less explosive.

For me it is not about how I feel about Article 370. For me it is about how the people of Kashmir feel about Article 370.

I would be utterly surprised if there are no street protests after the curfew is lifted. But peaceful protests should be encouraged. And the judicial option has to be encouraged. Those who disagree with the decision need to see there is a political way to oppose it.

By now the curfew has become a major issue of its own. And the longer the curfew lasts, greater the ammunition for those who could never side with the Indian government.

While warning of the consequences of lifting what he described as an “inhuman curfew,” Pakistani premier Khan demanded India do so and free all detainees....... Khan addressed the United Nations a day after the senior U.S. diplomat for South Asia called for a lowering of rhetoric between India and Pakistan, while saying that Washington hoped to see rapid action by India to lift restrictions it has imposed in Kashmir and the release of detainees there.

इमरान ने जनरल असेम्ब्ली में छक्का मारा





धारा ३७० को हटाना अगर गलत था तो लोग भारतमें सर्वोच्च अदालत को जाएँगे। लेकिन कर्फ्यु जो अभी तक जारी है वो तो बहुत गलत है। ये तो चीन ने जो १० लाख लोगों को डिटेन कर रखा है उससे भी दो कदम आगे चला गया। आप ८० लाख लोगों को खुले जेल में रखे हुवे हैं। ये तो बहुत गलत है।

आप कहते हैं काश्मीर के हित में है ये कदम। तो कश्मीरियों को खुले में आने दिजिए। जश्न मनाने दिजिए। ५०-५० दिन तक कहीँ कर्फ्यु लगाया जाता है?

मैं चाहुँगा इमरान अपना राजनीतिक दबाब बनाए रखे। नहीं तो कर्फ्यु कभी उठेगा ही नहीं।

काश्मीर के लोगों का मानव अधिकार भारतके संविधान में सुरक्षित है। काश्मीर में जो मानव अधिकार हनन है वो भारतके संविधान के विरुद्ध है।

आप अगर अपने देशके भितर मानव अधिकार हनन अगर करते हैं तो वो आतंरिक मामला नहीं रह जाता।

काश्मीर समस्या का समाधान कर्फ्यु और मार्शल लॉ नहीं हो सकता

इतिहास में क्या है उसी के तहत समस्या का समाधान ढुंढते रह जाएँगे तो फिर इतिहास में तो सब कुछ है। इतिहास में काश्मीर भारतका भी है और पाकिस्तान का भी। इतिहास में काश्मीर स्वतन्त्र देश भी है। इतिहास में भारत देश है भी और नहीं भी है। इतिहास में पाकिस्तान है भी और नहीं भी है। सिर्फ इतिहास को जिक्र कर के समस्या का समाधान ढूँढा नहीं जा सकता। इतिहास में तो एक से अनेक घाव हैं। पुरानी घावों को आप ताजा करेंगे?

इतिहास को बिलकुल नजरअंदाज भी नहीं किया जा सकता। लेकिन आपको सिद्धान्त पर चलना होगा। समस्या का समाधान सिद्धान्त पर चल के भी कठिन है लेकिन संभव है। कौन सा सिद्धान्त? कैसा सिद्धान्त? दुनियाकी सबसे बड़ी लोकतन्त्र का सिद्धान्त और क्या हो सकता है? लोकतन्त्र का सिद्धान्त।

जो लोकतन्त्र को मानते हैं वो ये मानते हैं कि ईश्वर ने प्रत्येक मनुष्य को बराबर का बनाया है। उसी सिद्धान्त के गणित को एक व्यक्ति एक मत भी कहते हैं। लेकिन लोकतन्त्र का मतलब बहुमत जो चाहे वो कर ले ये नहीं निकलता। लोकतन्त्र व्यक्ति से सम्बन्धित है। आप कह रहे हैं कि प्रत्येक मनुष्य के कुछ आधारभुत अधिकार होते हैं। उन अधिकारों को बहुमत तो क्या पुर्ण मत से भी नहीं छिन सकते हैं।

ये रियल इस्टेट की बात नहीं है। लोकतन्त्र का जमीन से सम्बन्ध होता तो दुनिया की सबसे बड़ी लोकतन्त्र भारतको नहीं माना जाता। छोटा सा देश भारत। भारत से लगभग तीन गुना बड़ा सहारा मरुभूमि है। सहारा को ही भारत से बड़ा लोकतन्त्र या देश कहते लोग। नहीं कहते हैं।

काश्मीर का मसला जमीन का नहीं है। काश्मीर का मसला वहाँ के अवाम से है।

एक होती है जमीनी यथार्थ। एक होती है क्लेम। यथार्थ है लाइन ऑफ़ कण्ट्रोल। क्लेम है कि पाकिस्तान और भारत दोनों पुरे के पुरे काश्मीर को क्लेम करते हैं। जब तक दोनों वो क्लेम करते रहेंगे टेंशन बना रहेगा। टेंशन बना रहेगा तो दोनों देशो में गरीबी बनी रहेगी। जितने गरीब लोग भारतके भितर हैं उतने दुनिका के किसी देश में नहीं।

गृह मंत्री कह रहे हैं ३७० हटा दिया। अब पाकिस्तान के अधीन जो काश्मीर है वो भी लेंगे। अक्साइ चीन भी लेंगे। कैसे लेंगे? ३७० तो हटाया बल प्रयोग कर के। बाँकी काश्मीर और अक्साइ चीन लेने के लिए पाकिस्तान और चीन से युद्ध करेंगे क्या? वो भी जानते हैं कि युद्ध असंभव है। बाँकी काश्मीर और अक्साइ चीन भारतका हो जाना असंभव बात नहीं है। लेकिन वहाँ तक पहुँचने का रास्ता युद्ध नहीं है। तीनो देश बातचीत करें। शायद रास्ता निकल जाए। आप ५० या १०० सालका टाईमटेबल निकालिए। शायद रास्ता निकल जाए।

नहीं अगर निकट भविष्य में ही हल निकालना चाहते हैं तो लोगों को इस तरह गुमराह मत किजिए।

जो लोकतन्त्र बिहार या महाराष्ट्र में है वही लोकतंत्र काश्मीर को भी दे सकते हैं तो कुछ हद तक माना जा सकता है कि चलो अकेले जितना कर सके किए। नहीं तो ये तो तानाशाही बात हो गयी। ये फ़ासिस्ट कदम हो गया।

वार्ता में होता है पॉस्चरिंग। थोड़ा बढ़चढ़ के बोलना होता है। बाद में वार्ता के दौरान थोड़ा पिछे हट जाते हैं और डील करते हैं।

ये जो कदम है ये स्थायी समाधान नहीं है। अस्थायी समाधान भी है कि नहीं ये कुछ समय बितने पर पता चलेगा। स्थायी समाधान है वार्ता। वार्ता किजिए। पाकिस्तान से। चीन से। फोर्मुला तो यही है कि तीनों देश लाइन ऑफ़ कन्ट्रोल को स्थायी सीमा मान लें और व्यापार पर फोकस करें। ताकि गरीबी को हटाया जा सके।

India, Nowhere Close To An "Emergency"

Advani's remarks are an unfortunate attempt to become relevant again. Politicians in Nepal similarly refuse to get the work done on federalism and the constitution because, as soon as the work is done, they are going to become irrelevant. Who in their right mind wants to become irrelevant?

People like Laloo and Mulayam rode the Mandal wave. Advani rode the Kamandal wave. Ab to Development Wave chal raha hai. Developent Wave ne Mandal aur Kamandal dono ko nigal liya hai. Modi's background makes him the ultimate Mandal, and his clear majority win makes him the ultimate Kamandal as well.

Adavani "Hindu rate of growth" jamane ke log hain. 2% aur 3% se kam chala lete the us samay mein log. When people like Nitish idolize him at a personal level, that is fine. But when they idolize him politically, main to confuse ho jata hoon. 

The BJP is a big tent. Us mein kism kism ke log hain. Kuchh log ultra conservative hain, kuchh Islamophobic log bhi hain, kuchh sexist log hain, actually dher sare sexist log hain, to tarah tarah ke log hain.

Lekin Advani aur Modi mein to Modi jyada liberal dikhte hain. Advani ne Ram Mandir ke naam par desh mein utna uthal puthal machaya tha. Bhul gaye?

Advani senior log hain. Aadar milni chahiye. There is no doubt about that. Shayad usi aadar bhav mein kami kamjori ho gayi hogi, to unhone hostile interview de dala. Ghabrane ki baat nahin hai. India is a democracy. Log to bolenge hi.

Laloo aur Advani dono ek jagah kisi mudde par aa jayenge, ye mujhe nahin maloom. Lekin aa gaye, emergency ke masale par. To wo po purani baat hai. 

India mein abhi emergency ki koi sambhavana nahin, koi gunjayas nahin. Waise Advaniji ne news mein aane ke liye kah diya.

Mehbooba Mufti

A Muslim woman as Chief Minister of the state of Kashmir ---- this is what I love about democracy. It throws up pleasant surprises like this. Before today I had never heard of her. I think this is amazing. I think other parties should throw outside support to her and let her do her thing. She is the people's choice.

Hindus in Pakistan and Bangladesh fare worse than Muslims in India ---- but that is no excuse for the fact that there is not equality for the Muslims in India. Equality is the goal and it has be achieved. That is the only way India can play a central role in the so-called War On Terror. India has to show Muslims can be equal, vibrant members of a dizzyingly diverse democracy. India has to show the way. The only way the War On Terror can conclude is by a total spread of democracy across the Muslim world. America is not in a position to have that central impact. It is too far away. It does not have enough Muslims.

The recent row over Article 370 in India surprised me. First, I don't seem to know much about it. I have a vague idea that it is some kind of a special provision for Kashmir that was put in place around independence/partition, but I don't have good knowledge of the details. I guess I can always google it up and I doubt it is that complex a concept.

But this row was bad timing. This was like Bill Clinton became president in 1992 and the gays in the military came up, and that was a major distraction from the major agenda of the economy.

Or it was designed to get the NDA partners to fall in line. I don't need you, so if you speak right on Article 370, I will still keep you. But I doubt that was the idea.

It would be disrespectful of Modi to suggest that.

I actually like the idea of science and math education in madarsas. I did not know science and math were not taught in madarsas when I read that line in the BJP manifesto summary before the election.

I am of the opinion the goal should not be to strengthen hold on Kashmir, the goal should be to attempt a South Asian Economic Union, so national borders are reduced to mere formalities. There is maximum trade and commerce. That is what is in the best interests of the people.

This article specifies that except for Defence, Foreign Affairs, Communications and ancillary matters (matters specified in the instrument of accession) the Indian Parliament needs the State Government's concurrence for applying all other laws. Thus the state's residents lived under a separate set of laws, including those related to citizenship, ownership of property, and fundamental rights, as compared to other Indians. ...... Similar protections for unique status exist in tribal areas of India including those in Himachal Pradesh, Arunachal Pradesh, Andaman & Nicobar Islands and Nagaland. However, it is only for the state of Jammu and Kashmir that the accession of the state to India is still a matter of dispute between India and Pakistan still on the agenda of the UN Security Council and where the Government of India vide 1974 Indira-Sheikh accord committed itself to keeping the relationship between the Union and Jammu and Kashmir State within the ambit of this article. ..... The 1974 Indira-Sheikh accord between Kashmiri politician Sheikh Abdullah and then Prime Minister Indira Gandhi stated, "The State of Jammu and Kashmir which is a constituent unit of the Union of India, shall, in its relation with the Union, continue to be governed by Article 370 of the Constitution of India". ...... B. R. Ambedkar, the principal architect of the Constitution of India, was against Article 370 and it was included against his wishes. Balraj Madhok reportedly said, Dr. Ambedkar had clearly told Sheikh Abdullah, "You wish India should protect your borders, she should build roads in your area, she should supply you food grains, and Kashmir should get equal status as India. But Government of India should have only limited powers and Indian people should have no rights in Kashmir. To give consent to this proposal, would be a treacherous thing against the interests of India and I, as the Law Minister of India, will never do it." Then Abdullah went to Nehru, who directed him to N. Gopalaswami Ayyangar, who approached Sardar Patel asking him to do something as it was a matter of prestige for Nehru, who had promised Abdullah accordingly. Patel got it passed when Nehru was on a foreign tour. On the day this article came up for discussion, Dr. Ambedkar did not reply to questions on it though he did participate on other articles. Accepting that J&K is an 'integral part' of India, Singh said that does not necessarily mean that it has to be treated exactly on par with other states. He said, "Hong Kong is an 'integral part' of China but has been given a special dispensation. There are in fact numerous examples around the world in which, due to special circumstances, certain areas or regions have been given a special dispensation. Though all talk of secession is totally unacceptable and uncalled for, the steam-roller approach is also not appropriate." ..... Singh also said that 50 percent of the area of his father's 84,000 sq miles state is in fact not in Indian possession. "It has been under Pakistan control since the UN's brokered ceasefire on 1 January 1949, and Pakistan has leased a considerable portion of this land to China. An interesting point also is that in the three regions of the state that are with us, Kashmir, Jammu and Ladakh, the bulk of public opinion differs sharply on this issue," he said.
Omar Abdullah & Ram Madhav start war of words over Article 370
Jammu & Kashmir Chief Minister Omar Abdullah has raised the pitch against the minister of state in the Prime Minister's Office Jitendra Singh's comments on repealing Article 370, saying that the Constituent Assembly will have to be recalled if the new BJP-led government at the Centre plans to pursue this agenda. Taking issue with Abdullah, senior Rashtriya Swayamsevak Sangh leader Ram Madhav said J&K would always remain an integral part of India, with or without the constitutional provision that grants a special status to the state. ...... "I understand the political compulsion of the BJP but the party should ponder upon the promises they have made to the people. Why attack J&K first?" he asked. ....... Abdullah has been consistently asserting that J&K has not merged but acceded to India. ...... "If you are attempting any change in Article 370, it means you want to renegotiate a new relationship with J&K," PDP president Mehbooba Mufti said. ...... "If BJP wants to bring the J&K people closer, they should talk about strengthening Article 370 rather than abolishing it," she said. "I hope Dr Singh does not put the foot in his mouth again and the Prime Minister intervenes and disciplines his ministers."
What is Article 370? Three key points
till 1965, J&K had a Sadr-e-Riyasat for governor and prime minister in place of chief minister.... According to this article, except for defence, foreign affairs, finance and communications, Parliament needs the state government's concurrence for applying all other laws. Thus the state's residents live under a separate set of laws, including those related to citizenship, ownership of property, and fundamental rights, as compared to other Indians. As a result of this provision, Indian citizens from other states cannot purchase land or property in Jammu & Kashmir. Under Article 370, the Centre has no power to declare financial emergency under Article 360 in the state. It can declare emergency in the state only in case of war or external aggression. The Union government can therefore not declare emergency on grounds of internal disturbance or imminent danger unless it is made at the request or with the concurrence of the state government.
